Can you smoke weed on the beach in California? The Law Says No
While California allows adults 21 and older to legally possess and cultivate cannabis, smoking it on public beaches is strictly illegal. Local municipalities (like Los Angeles or San Diego) enforce their own strict municipal codes. For example, smoking of any kind has been banned on all Los Angeles County beaches and piers for years.
Can you smoke weed on the beach in New York? The Law Says No
New York has a very unique public consumption law compared to other states. Under the Marijuana Regulation and Taxation Act (MRTA), adults are technically allowed to smoke cannabis anywhere that smoking tobacco is legal.
However, this creates a complete roadblock when it comes to the coastline:
New York State and New York City law explicitly ban smoking tobacco, e-cigarettes, and cannabis in all public parks, boardwalks, pools, and public beaches (such as Rockaway Beach, Coney Island, or Jones Beach).
Lighting up a joint on a NYC beach violates the Smoke-Free Air Act, putting you at risk for local civil fines and park enforcement citations. While recreational cannabis is fully legal at the state level in both California and New York, smoking on the actual sand is universally banned on public beaches.
To stay on the right side of local ordinances, you can skip the joints entirely on the sand.
